This website is operated by Francis Power Pty Ltd (ABN 26 694 678 692), Unit 89, 15-19 Edgehill Ave, Botany NSW 2019, Australia. "We", "us" and "our" mean Francis Power. By browsing or ordering from francis-power.com you agree to these terms. If you do not agree with them, please do not use the site.

You must be at least 18 years old and able to enter into a binding contract to place an order, or have the consent of a parent or guardian. You agree that the information you give us — including your name, phone number and delivery address — is accurate and current.

An account is required to place an order. You are responsible for keeping your password confidential and for activity that happens under your account. Tell us promptly if you believe someone else has accessed it. We may suspend or close an account that is being used fraudulently or in breach of these terms.

We make reasonable efforts to describe our equipment accurately, including specifications, weights and dimensions supplied by manufacturers. Product photography is indicative — finishes, colours and included accessories can vary between production runs. Where a specification matters to your decision, please confirm it with us before ordering.

Stock availability can change while your order is being processed. If an item becomes unavailable we will offer you an alternative, a backorder, or a full refund.

• All prices are shown in Australian dollars (AUD).
• Freight is quoted separately based on the size, weight and destination of your order, and is confirmed with you before dispatch.
• We may change prices at any time without notice, but a change will not affect an order we have already confirmed.
• Obvious pricing or typographical errors are not binding — if one affects your order we will contact you before proceeding and you may cancel for a full refund.

Placing an order is an offer to buy, not a completed contract. A contract is formed when we confirm your order and it is ready to be dispatched. We may decline an order because of stock availability, a pricing error, a delivery address we cannot service, or suspected fraud.

Payment is due before dispatch unless we have agreed otherwise in writing. For card payments, your card details are validated in your browser and are not stored on our servers; we will contact you to complete the payment. Ownership of the goods passes to you when payment has cleared in full.

Delivery timeframes, freight, damaged or faulty items, change-of-mind returns and refunds are covered in our Shipping & Returns policy, which forms part of these terms.

Strength and cardio equipment carries a risk of injury if it is assembled incorrectly, overloaded, or used without proper technique. Follow the manufacturer's instructions and load ratings, have heavy equipment installed on a suitable floor, and seek advice from a qualified professional before starting a new training programme. Nothing on this website is medical or training advice.

The layout, text, graphics and photography on this site are owned by us or used with permission, and may not be copied or republished without our written consent. Brand names and logos belong to their respective owners and are used to describe the products we sell.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. Subject to those rights, we exclude all liability for indirect, special or consequential loss arising from your use of this website or the products you buy from us — including loss of profit, loss of use, or costs of substitute equipment.

Where we are liable and the law permits us to limit that liability, our liability is limited, at our option, to replacing or repairing the goods, resupplying equivalent goods, or paying the cost of doing so.

Our site may link to manufacturer or courier websites. We do not control those sites and are not responsible for their content, products or privacy practices.

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales. If a dispute arises, please contact us first — we would much rather resolve it directly and quickly.

We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.
